Edward Whitby was born in Chester in c. 1578. He matriculated at Brasenose College, Oxford on 12 November 1596, at the age of eighteen. He graduated B.A. on 3 December 1599. Whitby subsequently entered the Inner Temple in 1600 and was called to the bar in 1610. He became recorder of Chester in 1613. He also served Chester as an M.P. in 1614 and throughout the 1620s. Whitby died on 18 April 1639, and was buried in St Mary's Church, Chester. The diary of his brother Thomas, held at the Cheshire Archives (CR 374), records an attempt to unseat Edward from the recordership of Chester.
